Constitutional Court to look into whether judges can force minors and seniors to vaccinate against COVID

The Constitutional Court will examine whether judges can compel children and the elderly to be vaccinated. The Plenary Session of the Court of Guarantee accepted the pending appeal for protection, which, according to it, was filed by “elderly people and minors” against “the court’s decision to vaccinate against Covid-19”.
The people who filed the appeal, the Constitutional Court said in a statement, said they understood that the vaccine, which they considered to be “in an experimental phase,” should be something voluntary and that court decisions forcing them to vaccinate were “contrary to recognized fundamental rights.” Not only in the constitution but also in international treaties and agreements.
The Constitutional Court allows the processing of these resources because it understands that there is no doctrine on similar cases and because the case presented by them “goes beyond the scope of the specific case, because it raises a legal issue of current and public importance”.
