Travis McMichael, who killed Ahmaud Arbery and is already serving a life term for the crime, was sentenced once more on Monday to life in prison plus 10 years for federal hate crime charges.

In connection with the slaying of Ahmaud Arbery, Travis McMichael was given a second life term for a federal hate crime.

Following his federal convictions this year on interference with rights — a hate crime — coupled with attempted kidnapping and weapon use charges, Travis McMichael, one of the three White men convicted in the killing of Ahmaud Arbery, was sentenced on Monday to life in prison plus 10 years.

The sentences for his father Gregory McMichael and his neighbor William “Roddie” Bryan, who were found guilty of the same federal offenses, are scheduled to be handed out later on Monday at the same Georgia courthouse.

Due to their convictions in state court on a number of crimes, including felony murder in connection with the death of the 25-year-old Black man, all three are already serving life sentences. Before Travis McMichael’s sentencing was announced, Arbery’s mother Wanda Cooper-Jones, and other family members pleaded with the judge to impose the harshest term allowed by federal guidelines: “My son was shot not once, not twice, but three times.”

I felt every gun that was fired every day, your honor,” she added.  In some ways, the murder of Arbery, which occurred months before the police death of George Floyd in Minneapolis, served as a prelude to the widespread protests that summer as demonstrators denounced how occasionally people of color are handled by law officials. 

In February, a federal jury found McMichael, his father, and Bryan guilty of the counts after adopting the prosecution’s claim that the defendants harbored racial animosity toward Arbery. While his father, Gregory McMichael, was found guilty of using and carrying a.357 Magnum pistol, McMichael, who fatally shot Arbery, was also found guilty of using and carrying a Remington shotgun.

Travis McMichael will serve his life sentence, 20 years

According to a ruling made on Monday by US District Court Judge Lisa Godbey Wood, Travis McMichael will serve his life sentence, 20 years for the attempted kidnapping conviction, and an additional 10 years for the weapons charge consecutively. The judge determined that McMichael lacked the resources to pay a fine.

Amy Lee Copeland, McMichael’s attorney, argued on Monday that her client should continue to be held in federal custody and should complete his sentence with the Federal Bureau of Prisons rather than the Georgia Department of Corrections. Copeland testified in court that he has received “hundreds” of threats and that McMichael fears for his life while incarcerated in a state jail. She reasoned, admitting the “rich irony,” that making him spend the sentence in a Georgia state jail would essentially be a “backdoor death punishment” and leave McMichael up to “vigilante justice.”

Attorneys argued against the request. They contended that when a criminal is charged in more than one jurisdiction, the jurisdiction that sentences the offender first has precedence. According to McMichael, the judge concurred, stating that she lacked “neither the authority nor the inclination” to deviate from the law. Federal prosecutors centered their argument on how each defendant had used aggressive, disparaging, and racist words to speak about Black people in public and in private.

Chased and Killed

On February 23, 2020, the defendants chased and killed Arbery in their area outside of Brunswick, Georgia, according to prosecutors and the former high school football player’s family. They said that Arbery was out for a jog, which was a regular activity for the man.

Defense lawyers said that the McMichaels chased Arbery through residential streets in a pickup truck because they thought he fit the description of someone seen on video taken at a house that was still under construction. Arbery had previously broken into the house, but he never took anything, according to the prosecution.

Travis McMichael, according to the defense, shot Arbery in self-defense while they fought over McMichael’s shotgun. Bryan saw the McMichaels follow Arbery in their pickup and joined the chase in his own truck. Bryan also videotaped the shooting. The defendants weren’t detained for more than two months after Glynn County police received a stop-arrest order from two prosecutors, and then only after Bryan’s video of the killing went public and sparked a widespread outcry.
